3. About Bespoke Stage Bikinis
Bikini Boutique provides individually designed and made stage bikinis created specifically for each customer's requirements.
A bespoke stage bikini may involve individual design work, fabrics, colours, crystal/diamanté selections, embellishment, measurements, shaping, coverage and other specifications selected or agreed with the customer.
Because each garment is individually produced, the finished garment may contain minor variations associated with handmade production. Such variations do not constitute a defect where they do not materially affect the agreed design, quality or intended use of the garment.
4. Design Consultation & Design Brief
The customer's design may be discussed during an in-person consultation, video consultation, telephone conversation, written correspondence, drawings, reference photographs or a combination of these.
Bikini Boutique will make a record of the design requirements discussed during the consultation.
The design brief may include, where applicable:
- overall bikini style;
- top and bottom shape;
- coverage;
- colour;
- fabric;
- crystal type;
- crystal colour;
- crystal placement;
- straps and connectors;
- embellishment;
- requested level of coverage;
- measurements;
- competition requirements;
- reference images supplied by the customer; and
- other agreed design details.
The customer's final order is based on the agreed design brief and not solely on inspiration photographs or verbal descriptions such as "very sparkly", "blingy", "glamorous" or similar subjective descriptions.
Where a specific material, colour, crystal or fabric is selected, the selected material will form part of the agreed specification.
5. Design Approval
Before production begins, the customer is responsible for reviewing the design information provided and raising any concerns or requesting changes.
Where a written design confirmation, sketch, digital design, photograph, message or other confirmation is provided, the customer should verbally or written confirm that the information accurately represents the requested design before production proceeds at the initial design appointment.
Once production has commenced, changes to the agreed design may result in additional costs and/or changes to the estimated completion date.
Where the customer requests a change after production has commenced, Bikini Boutique will advise whether the requested change is possible and whether additional charges apply.
6. Reference Photographs & Inspiration Images
Reference photographs supplied by the customer are treated as inspiration or design references unless specifically agreed otherwise.
A reference photograph may depict a different body shape, garment construction, fabric, lighting, crystal arrangement, camera angle or level of embellishment.
The finished garment will therefore not necessarily be visually identical to a reference photograph unless the specific characteristics of that photograph have been expressly agreed as part of the customer's design specification.
7. Fabrics, Crystals & Materials
Where practical, customers may be shown fabric, crystal, connector or other material options before production.
Once a customer has selected or approved a particular material, that material will be used in the garment unless otherwise agreed.
Customers should consider the appearance of materials under normal lighting as well as stage lighting where relevant.
The appearance of crystals, and reflective materials can vary depending on lighting, photography, camera settings and viewing angle.
If a customer requires a particular crystal type, colour, density or placement, this should be specifically recorded in the design brief notes.
A general request for a garment to be "sparkly", "blingy" or "very sparkly" will be interpreted in accordance with the specific materials, embellishment and design agreed during the consultation.
8. Measurements & Fit
The customer is responsible for providing accurate measurements where measurements are supplied by the customer.
Where measurements are taken by Bikini Boutique, they will be recorded as accurately as reasonably possible at the time of measurement.
The customer understands that a stage bikini is a close-fitting performance garment and that fit can be affected by:
- body position;
- posing;
- movement;
- muscle engagement;
- changes in body weight;
- changes in body composition;
- changes in measurements;
- tanning products;
- adhesives or competition products;
- underwear or other garments worn underneath;
- the customer's method of putting the garment on; and
- individual body shape.
A garment fitting differently from an off-the-rack garment does not, by itself, establish that the garment is defective.
Where a genuine fit concern is identified, Bikini Boutique may request photographs, measurements or an in-person/video assessment in order to determine whether an alteration is appropriate.
9. Alterations
Where a customer believes that a bespoke garment requires an alteration, the customer should contact Bikini Boutique promptly and provide sufficient information for the issue to be assessed.
Bikini Boutique may request photographs, measurements, videos or an in-person fitting before determining the appropriate alteration.
Where an alteration is reasonably required to bring the garment into conformity with the agreed specification, Bikini Boutique will consider an appropriate remedy in accordance with the customer's statutory rights.
Where an alteration is requested because the customer has changed their preferred design, changed their measurements, changed their body shape or requested a design change that was not part of the original agreement, additional charges may apply.
A customer is not required to accept an alteration instead of exercising any statutory remedy that they may have under applicable consumer law.
10. Changes to Body Measurements
The customer is responsible for informing Bikini Boutique of any material change to their measurements before production or fitting.
If the customer's measurements change after the measurements used for production have been confirmed, Bikini Boutique cannot guarantee that the garment will fit in the same way.
Where an alteration is required solely because the customer's measurements have changed after the agreed measurements were taken, the alteration may be chargeable.
11. Customer-Requested Changes
Once the design has been approved and production has commenced, the customer may request changes.
Bikini Boutique will advise whether the requested changes can reasonably be made.
Additional costs may apply for:
- additional crystals;
- redesign work;
- additional labour;
- replacement components;
- structural alterations;
- additional fittings; or
- other work resulting from a customer-requested change.
No additional work will be undertaken at an additional cost without the customer's agreement to that cost.
12. Bespoke Orders & Cancellation
Bespoke stage bikinis are made specifically for the individual customer and are not standard stock items.
Where applicable under UK consumer law, goods made to the customer's specifications or clearly personalised are excluded from the usual statutory cancellation right applying to many distance or off-premises contracts.
This does not remove or restrict any statutory rights the customer has where goods are faulty, or fail to conform to the contract.
Where a customer wishes to cancel a bespoke order before completion, Bikini Boutique will consider the request based on the stage of production and the customer's legal rights.
Where the law permits Bikini Boutique to retain amounts properly payable for work or materials already undertaken or supplied, the customer will be informed of the relevant position.
Nothing in these Terms & Conditions is intended to exclude or restrict rights that cannot legally be excluded or restricted.
13. Refunds & Statutory Rights
Bikini Boutique does not provide refunds simply because a customer changes their mind about a bespoke design after the garment has been produced where no statutory right to a refund applies.
However, this does not affect the customer's statutory rights.
A customer may have legal rights where goods are, for example:
- not as described;
- not of satisfactory quality;
- not fit for a particular purpose made known to the trader; or
- otherwise fail to conform to the contract.
Where a customer raises such an issue, Bikini Boutique will assess the complaint against the agreed design brief, order information and applicable law.
Nothing in these Terms & Conditions excludes, restricts or attempts to remove a customer's statutory rights.
14. Complaints & Opportunity to Assess
If a customer believes that their garment has a defect or does not conform to the agreed specification, they should contact Bikini Boutique as soon as reasonably possible.
The customer may be asked to provide:
- photographs;
- videos;
- measurements;
- details of the issue;
- photographs showing the garment being worn;
- the circumstances in which the issue occurs; or
- access to the garment for inspection.
This information allows Bikini Boutique to assess the complaint properly.
Where appropriate, Bikini Boutique may offer a reasonable opportunity to inspect, repair or alter the garment in accordance with the customer's statutory rights.
Nothing in this section prevents the customer from exercising any statutory remedy available to them.
15. Customer's Personal Preferences
Bespoke design involves interpretation of the customer's requirements.
A customer's subsequent preference for a different colour, shape, coverage, crystal density, fabric, design or overall aesthetic does not automatically mean that the original garment was defective or failed to meet the agreed specification.
Where the garment conforms to the agreed specification, a request to change the design after completion may be treated as a customer-requested alteration and may incur additional charges.
16. Competition & Stage Requirements
The customer is responsible for informing Bikini Boutique of any specific competition rules or federation requirements that the garment must meet.
Where a customer requires compliance with particular rules concerning:
- coverage;
- connectors;
- bottoms;
- crystal placement;
- colour;
- fabric;
- straps;
- tanning;
- stage presentation; or
- other competition requirements,
these requirements must be communicated before production.
Bikini Boutique will use the information provided by the customer when producing the garment.
The customer remains responsible for checking the applicable rules of their particular competition or federation.
17. Completion & Collection/Delivery
The estimated completion date is an estimate unless a specific guaranteed date has been expressly agreed in writing.
The customer should provide any competition date or other deadline as early as possible.
Where a customer has an important competition deadline, this should be confirmed with Bikini Boutique before the order is accepted.
Once the garment is completed, the customer will be notified in accordance with the agreed collection or delivery arrangements.
18. Care of the Garment
Bikini Boutique will provide appropriate care instructions where applicable.
All stage bikinis are hand wash only, please do so in lukewarm water with a little soft mild detergent and press through bikini. Please do not get connectors wet as this will damage them. If they do get wet dry them immediately to prevent damage. The connectors are very delicate and must be handled with extra care, we do not hold responsibility for broken connectors or gems falling out after 14 days of sending your suit. If within the 14 days we will replace these connectors, after 14 days we reserve the right to charge for this service. It is normal for some crystals to fall off after time and wear but do not worry we pack extra crystals for you in your box to replace any that do fall off after some time. Please store your bikini hung up and covered, not packed up together in a box and please keep the top and bottoms separate from each other due to the glue. When the glue is touching other glue this can stick so to keep your bikini in best condition hang up separately without any folds to the bottoms in a cool dark place covered. To keep the connectors looking new clean with jewellery cleaner every now and then.
The customer is responsible for following the care instructions provided.
Damage caused by inappropriate washing, cleaning, storage, adhesives, tanning products, alterations by another person, excessive force, misuse or other customer actions may not be covered as a manufacturing defect.
Where a garment has been altered by another person after delivery, Bikini Boutique may need to assess whether the alteration has affected the issue complained of.
19. Photographs & Finished Garments
Bikini Boutique may request permission to photograph completed garments for its portfolio, website or social media.
Photographs will only be used for marketing purposes where the customer has provided the appropriate consent.
Marketing consent is separate from acceptance of these Terms & Conditions.
20. Communication & Records
Bikini Boutique may retain relevant records relating to the order, including:
- design notes;
- measurements;
- correspondence;
- photographs;
- material selections;
- invoices;
- payment records;
- design confirmations;
- alteration requests; and
- complaint correspondence.
These records may be used to administer the order and to resolve any subsequent dispute.
21. Consumer Rights
These Terms & Conditions are intended to operate alongside applicable UK consumer law.
Nothing in these Terms & Conditions is intended to exclude, restrict or remove any statutory right or remedy that cannot legally be excluded, restricted or removed.
Where there is a conflict between these Terms & Conditions and a mandatory statutory consumer right, the statutory right will apply.
22. Complaints Resolution
Bikini Boutique aims to resolve complaints directly and professionally.
Where a customer raises a concern, Bikini Boutique will consider the complaint based on the agreed specification, available evidence and applicable consumer law.
Customers should provide sufficient information to enable the complaint to be assessed.
Where appropriate, Bikini Boutique may offer an inspection, fitting, alteration, repair or other remedy.
If the customer rejects a proposed remedy, Bikini Boutique will record that the remedy was offered and that it was declined.
23. Agreement
By approving the design and proceeding with the order, the customer confirms that they have:
- provided accurate information and measurements to the best of their knowledge;
- communicated any relevant competition requirements;
- reviewed the agreed design;
- reviewed the selected fabrics and/or materials where provided;
- had the opportunity to raise questions or request changes before production;
- understood that the garment is being individually made to their specifications; and
- understood the terms set out above.
These Terms & Conditions do not affect the customer's statutory rights.
